Artykuł podejmuje problematykę wyjaśnień oskarżonego, ukazując ich dualistyczną rolę - środka dowodowego oraz środka służącego obronie oskarżonego. Autor rozważa, czy w zakresie przysługującego oskarżonemu prawa do obrony mieści się prawo do kłamstwa, a także zajmuje stanowisko w odniesieniu do granic skła- dania przez oskarżonego fałszywych wyjaśnień. Następnie przedstawia uwagi dotyczące posługiwania się kłamstwem przez obrońcę oskarżonego w ramach taktyki obrony. Refleksje te zostały oparte na badaniach własnych autora polegających na przeprowadzaniu pogłębionych wywiadów z adwokatami wykonującymi funkcję obrońców.

This article discusses the issue of explanations given by an accused person, showing their dual nature - that of evidence and that of a measure used for the purpose of defence. The author raises a question if the scope of the right to defence granted to the accused encompasses the right to lie, and takes a stand on the limits to the accused making false statements. This is followed by comments on the practice of defence counsels making use of falsehood as part of their defence strategies. The reflection has been based on the author's own studies involving in-depth interviews made with barristers working as defence counsels.

Tak zwana „ustawa o bestiach" stanowi regulację prawną dotyczącą postępowania ze sprawcami szczególnie niebezpiecznymi skazanymi prawomocnymi wyrokami na wiele lat przed jej wejściem w życie i dotyczy postępowania wobec nich po odbyciu przez nich kary pozbawienia wolności. Jej uchwaleniu oraz wejściu w życiu towarzyszyło wiele kontrowersji prawnych, co w efekcie doprowadziło do jej zaskarżenia do Trybunału Konstytucyjnego. Trybunał Konstytucyjny uznał, że umieszczenie osób uznanych za szczególnie niebezpieczne nie narusza konsty- tucyjnych gwarancji praw jednostki. TK stwierdził, że umieszczenie w Ośrodku nie ma charakteru karnego, a jedynie administracyjny, i nie stanowi orzekania drugi raz w tej samej sprawie. Artykuł krytycznie odnosi się do tezy TK i przed- stawionej przezeń argumentacji.

The so-called „Beasts Act" is a legal regulation, which deals with particularly dangerous perpetrators convicted by valid sentences for many years before its entry into force and concerns the proceedings against them after serving their prison sentences. Its enactment and entry into force was accompanied by a lot of legal controversy, which ultimately led to its appeal to the Constitutional Tribunal. The Constitutional Tribunal held that the inclusion of people regarded as particularly dangerous does not violate constitutional guarantees of individual rights. The Court said that the placement of the Centre is not of a criminal nature, but only administrative and it is not ruling a second time in the same case. The article critically refers to the thesis of the Constitutional Tribunal and its argumentation.

Problem przemocy „honorowej" jest zjawiskiem przekraczającym granice państw, kultur i religii. Przemoc ta najczęściej bywa łączona z krajami i regionami Bliskiego Wschodu - Jordanią, Libanem, Palestyną, irackim Kurdystanem. W Europie oma- wiana kwestia pojawiła się w debacie publicznej dopiero na początku XXI w. i zo- stała ograniczona do kontekstu migracyjnego. Efektem takiej kategoryzacji przemocy „honorowej" jest polityzacja zjawiska, przejawiająca się w silnym uzależnieniu działań podejmowanych przez państwo od takich czynników, jak linia polityczna rządzącej partii czy nastroje społeczne. Celem niniejszego artykułu jest udzielenie odpowiedzi na pytanie o to, w jaki sposób uregulowano prawnie problem prze- mocy „honorowej" w wybranych krajach i regionach: Libanie, Jordanii, irackim Kurdystanie, Wielkiej Brytanii, Holandii i w Niemczech. Umożliwi to identyfikację sposobów walki z tym problemem i wskazanie, czy kontekst migracyjny wpływa na zróżnicowanie stosowanych rozwiązań. Przedmiotem analizy będzie regulacja prawna, a także orzecznictwo sądów oraz działalność różnych instytucji rządowych oraz pozarządowych nakierowanych na walkę z tym problemem. Wyniki badań prowadzą do refleksji nad tym, czy prawo karne rzeczywiście jest najefektywniejszym instrumentem rozwiązania omawianego problemu. Badana problematyka wpisuje się w szerszy kontekst zagadnienia wykorzystywania narzędzi prawnych do osiągania określonych celów polityk publicznych.

The problem of „honour"-related (or „honour"-based) violence is a phenomenon that crosses the boundaries of countries, cultures and religions. Usually it is tended to be connected with various regions of the Middle East, such as Jordan, Lebanon, Palestine, Iraqi Kurdistan. In Europe this issue has appeared in public debates at the beginning of XXI century and it was restricted to the migration context. Such categorization has resulted in the politicization of „honour" - related violence, which is manifested in the strong relation between state's undertaken actions and such factors as political line of a ruling party or public opinions. The aim of this article is to answer the question about legal regulation of this issue in the chosen countries of the Middle East and Europe: Lebanon, Jordan, Iraqi Kurdistan, the United Kingdom, the Netherlands and Germany. Such comparison will result in the identification of means and methods of combating this kind of violence that are used in practice. Moreover, it will enable the author to indicate whether the migration context has an impact on the differentiation of undertaken actions. The subject of the analysis will be the legal regulation and jurisdiction, as well as activity of various public and non-governmental institutions that are involved in the prevention of this problem. The result of the analysis leads to the reflection on the question if penal law is really the most effective instrument of solving this problem. Discussed matter fits into the wider context of an issue of use of law in order to achieve the aims of public policies.

W dobie globalnych sieci teleinformatycznych działania podejmowane w cyber- przestrzeni nie są ograniczone przestrzenią i czasem, a udostępniane treści mogą docierać do potencjalnie nieograniczonego grona odbiorców. Nawet jeśli dostęp do nich uzależniony jest od wypełnienia dodatkowych warunków, to na ogół ich spełnienie nie jest na tyle kłopotliwe, aby taki dostęp utrudniało. Łatwość udostęp- niania oraz złudne poczucie całkowitej anonimowości wpływają na udostępnianie materiałów multimedialnych zawierających także treści prawem zakazane. Nie- zwykle niepokojącym, i niestety, coraz częstszym zjawiskiem jest udostępnianie w sieci zdjęć osób nagich bądź osób w trakcie czynności seksualnych - dokonywane bez ich wiedzy i zgody. Polskie prawo karne dostrzega wagę problemu, penalizując zachowania związane z utrwalaniem i upublicznianiem wizerunku osoby nagiej lub w trakcie czynności seksualnych, jednak wydaje się, że kategoria czynów karalnych ujęta jest zbyt wąsko, co należy ocenić krytycznie. Celem przedstawionych rozważań jest próba analizy zakresu kryminalizacji regulowanej w art. 191a k.k. oraz sformułowania postulatów de lege ferenda.

In the times of global ICT networks, activities pursued online are not limited by space and time, and the content shared in cyberspace may reach a potentially unlimited audience. Even if access to this content requires some additional conditions to be fulfilled, it is usually not as problematic as to make this access more restricted. The ease of sharing and the illusory sense of complete anonymity online contributes to sharing multimedia materials also featuring content prohibited by law. A highly disturbing and, unfortunately, increasingly common phenomenon is the online sharing of images of people engaged in a sexual intercourse - with these images being shared without their knowledge and consent. Polish criminal law is aware of the significance of the problem, penalising behaviour involving recording and publishing images of nude persons engaged in sexual activity. It seems, however, that the category of punishable acts is too narrow, which shall be subject to criticism. The objective of the discussion presented herein is to make an attempt to analyse the scope of criminalisation regulated under Article 191a of the Criminal Code (hereinafter: the CC) and formulate a set of de lege ferenda demands.

The present paper deals with the contemporary controversy on the issue of death penalty, concentrating primarily on three aspects of the general debate on the matter. The goal of the article is to cover the arguments and counterarguments that have emerged today amidst the discussion on these topics. In order to achieve this goal, the present paper, after a short theoretical introduction, analyses the arguments of this debate in three separate chapters based on three distinct topics since an unintentional misunderstanding and deliberate misconceptions stem primarily from the fact that abolitionists and retentionists tend to talk alongside each other. Hence, the present article reviews three selected matters of the capital punishment controversy (humanity, necessity/death penalty vs. life imprisonment, and serving the purpose of punishment) separately. Presenting the idea in such a manner can, hopefully, clear the different standpoints and make it possible to reach a mutual understanding (albeit not agreement with each other). Due to the lack of space and for rationality considerations, this article does not cover other, also very important, matters (e.g. deterrent effect, miscarriage of justice, financial, and other aspects).

Rozważania na temat studiów prawniczych i aplikacji współcześnie w Polsce przedstawione zostały w artykule z perspektywy pytania o cele kształcenia prawników oraz o to sposób prowadzenia kształcenia prawniczego jest właściwy. Wskazując na determinowaną ustrojowo rolę prawników wykonujących zawód w ramach zinstytucjonalizowanych struktur wymiaru sprawiedliwości artykuł skupia się między innymi na zagadnieniach dotyczących doboru przedmiotów. Zwłaszcza jednak na dylemacie, czy efektem kształcenia prawniczego mają być sprawni technicy prawa, czy elity współformujące profil etyczny, intelektualny, kulturowy i gospodarczy społeczeństwa. Zawarte w artykule poglądy przedstawione zostały począwszy od oceny znaczenia wiedzy na rynku, poprzez wskazanie przydatności programów studiów dla dalszego rozwoju zawodowego prawników zarówno podczas aplikacji, jak i w innych zawodach, aż po porównanie nauczania według podziałów na tradycyjne gałęzie prawa i nowopowstające jego obszary. Artykuł odnosi się także do postulatów otwarcia prawa na interdyscyplinarności i do roli prawnika jako zawodu zaufania w kontekście stałej potrzeby wzmacniania zaufania do samego prawa.

A discussion on the law studies and the legal apprenticeship system in Poland has been offered in the article from the point of view of a question about the objectives of educating lawyers and about whether the current system of legal education is appropriate. By pointing to the system-determined role of lawyers pursuing their profession within institutionalised structures of the system of justice, the article concentrates, among others, on issues concerning the selection of the subjects to be taught. But especially on the dilemma whether legal education should produce skilled law technicians or elites co-shaping the ethical, intellectual, cultural, and economic profile of society. The views contained in the article are presented starting from an assessment of the significance of market knowledge through a determination of the utility of curricula for further professional development of lawyers both as actual lawyers and pursuing other professions and ending with a comparison of teaching broken down into traditional branches of law and newly-forming fields thereof. The article addresses also the claims for opening law to interdisciplinarity and the role of lawyer as a profession of trust in the context of a constant need to reinforce the trust in law itself.

Niniejszy artykuł dotyczy pojęcia gwiezdnych wojen, w celu pokazania, że jest to tematyka opisująca rzeczywistość, a nie tylko historia (choć z nią często kojarzona). Aktualna polityka prowadzona przez państwa w Kosmosie pokazuje, że konflikty kosmiczne są nadal możliwe. Stąd bezpieczeństwo prowadzonej przez państwa działalności kosmicznej jest zagrożone - i to nie tylko w przestrzeni kosmicznej, ale i na Ziemi. I choć aktywną działalność w kosmosie prowadzą tylko niektóre państwa, to skutki tych działań (czy to cywilnych, czy militarnych) od- czuwa cała społeczność międzynarodowa. Militaryzacja Kosmosu zaczyna powoli wkraczać w nową fazę: użycia satelitów aktywnych, przeznaczonych do niszczenia wyznaczonych celów. Taki stan rzeczy świadczy o tym, iż gwiezdne wojny to nie jest fikcja, gdyż być może w przyszłości państwa ponownie będą rozwiązywać swoje konflikty z użyciem kosmosu.

The article covers the notion of star wars, aiming to show that it is an idea describing the reality, not just a story (although often associated with one). The space policies implemented at present by different countries prove that space conflicts are still possible. Therefore, the security of the space activity pursued by various countries is compromised - not only in space but also on Earth. And although only some countries carry out space activity, the effects of this activity (be it civil or military) are felt by the entire international community. The militarisation of space is slowly entering a new stage: the stage of use of active satellites, designed to destroy pre- defined targets. This situation means that star wars are not fiction since it can happen in the future that feuding countries will be settling the conflicts arising between them in cosmic space.

W artykule podniesiono kilka aspektów jasności tekstów aktów prawnych w od- niesieniu do jej rozumienia przez różne podmioty (ekspertów i laików). Są to jednocześnie dwa różne punkty widzenia i dwie różne propozycje mające pomóc w zrozumieniu prawa (tekstów aktów prawnych). Artykuł koncentruje się na zagadnieniach: (1) znaczenia jasności tekstu aktu prawnego (jako tekstu, który nie jest tekstem użytkowym), (2) kompetencji językowej, kompetencji komunikacyjnej, prawniczej kompetencji komunikacyjnej, (3) dyskursu prawniczego, (4) zagadnieniu uproszczenia języka tekstu aktu prawnego jako remedium zapewniającego jasność prawa, (5) edukacji rozwijającej prawniczą kompetencję komunikacyjną.

The article undertakes a few aspects of clarity of legal texts acts for expert and for layman. There are two different points of view and two supporting proposals, which help to understand a law (a legal text act). The article focused on following issues: (1) a meaning of clarity of legal text act (as a specialized text), (2) linguistic competence, communicative competence, legal communicative competence, (3) legal textuality discourse, (4) question of simplification as a remedy for clarity of law, (5) legal text education as a developing of legal communicative competence.

W artykule przedstawiono zjawisko „karuzeli podatkowej" w podatku od towarów, które jest swoistym nadużyciem prawa i służy wyłudzenia VATu. Po przedstawieniu doktryny orzeczniczej nadużycia prawa i dobrej wiary wypracowanej przez Trybunał Sprawiedliwości Unii Europejskiej dokonano analizy orzecznictwa w tym zakresie, z którego wynika, że podatnicy zajmujący się wyłudzaniem podatku od wartości dodanej nie mają prawa do zwrotu podatku. Natomiast podatnicy, którzy padli ofiarą oszust podatkowych mogą powoływać się na doktrynę dobrej wiary i mają prawo do odliczenia podatku. Orzecznictwo Trybunału Sprawiedliwości Unii Europejskiej w istotny sposób wpływa na orzecznictwo sądów administracyjnych w Polsce. NSA w uzasadnieniach rozstrzygnięć stara się zdefiniować pojęcie „karuzeli podatkowej", które jest bardzo zróżnicowane.

The article discusses the phenomenon of "tax carousels" in the tax on goods and services, which is a specific abusive practice and is used for VAT refund scam purposes. A discussion on the jurisprudential doctrine of the abuse of law and good faith as offered by the Court of Justice of the European Union is followed by an analysis of the judicial decisions (case-law) issued in this area, which proves that taxable persons involved in value-added tax fraud practice have no right to a tax deduction. Meanwhile, those taxable persons who have fallen victim to tax fraud practices may quote the good faith doctrine and exercise the right to a tax deduction. The judicial decisions of the Court of Justice of the European Union have had a significant impact on the judicial decisions issued by administrative courts in Poland. The Supreme Administrative Court (SAC) tries to define the notion of a "tax carousel" in its decisions, as the notion is quite broad.

Głównym celem artykułu jest rozważenie dopuszczalności stosowania art. 58 § 2 k.c. w prawie zabezpieczeń społecznych względem umów o pracę zawieranymi z kobietami ciężarnymi z punktu widzenia teorii sprawiedliwości. Chciałbym dowieść, iż stosowanie art. 58 § 2 k.c., skutkujące wyłączeniem kobiet ciężarnych z systemu ubezpieczeń społecznych, jest nie tylko wątpliwe z punktu widzenia Konstytucji RP, ale problematyczne z punktu widzenia rodzaju sprawiedliwości realizowanego przez prawo zabezpieczeń społecznych. W pierwszej części artykułu przypominam podstawowe typologie i definicje pojęcia sprawiedliwości. Choć w refleksji filozoficznej nie można mówić o 11jednej sprawiedliwości", to jest to pojęcie o ugruntowanej tradycji. Stawiam tezę, że o ile sprawiedliwość rozdzielcza jest urzeczywistniana przepisami prawa konstytucyjnego oraz zabezpieczeń społecznych, o tyle prawo cywilne realizuje przede wszystkim sprawiedliwość komutatywną, co dotyczy również art. 58 § 2 k.c. Następnie pokazuję konsekwencje stosowania art. 58 § 2 k.c. w prawie ubezpieczeń społecznych na przykładzie spraw kobiet ciężarnych wyłączanych z systemu ubezpieczeń społecznych. Artykuł zwieńcza konkluzja, iż choć sprawiedliwość dla prawników jest pojęciem o długiej tradycji, to niestety często jest wymierzana intuicyjnie, co prowadzi do niepożądanych i nieobliczalnych konsekwencji społecznych.

The main aim of this paper is to consider the acceptability of application of Article 58 § 2 of the Polish Civil Code in the social security law in the regard to employment contract with pregnant women from the point of theory of justice. I argue that application of Article 58 § 2 of the Polish Civil Code resulting in exclusion of pregnant women from social security system not only might be doubtful from the constitutional law perspective, but it is also problematic from the point of view of the concept of justice realized by social security law. In the first part I recall in short basic typologies and definitions of justice. This leads to the observation, that although in philosophy there is no one understanding of justice, this notion has a long and established tradition. In following parts I ana- lyze which concepts of justice are being realized by constitutional law, civil law and social security law. I argue that as constitutional law and social security law deal mostly with distributive justice, civil law realizes mostly commutative justice, which also concerns Article 58 § 2 of the Polish Civil Code. In the last part I demonstrate consequences of applying Article 58 § 2 of the Polish Civil Code in the social security law on the example of pregnant women being excluded from the social security system. This is followed by the final conclusion that although also for lawyers notion of justice has a long tradition, it is often im- posed in spite of "locally" realized types of justice, which leads to unwelcome and unforeseeable consequences.
