The article discusses the matter of the right to a clean environment and clean air as a personal interest and the possibility of enforcing judgements issued in this area. The authors of the paper address the controversial issue of the classification of this right, analysing whether it can be considered a personal interest directly associated with a natural person. It is also important to identify the relevant entity representing the defendant in such cases, especially when the defendant is the Treasury. In order to pursue claims on the grounds of violations of the right to clean air, it is necessary to determine the guilt of a specific perpetrator. The paper discusses examples of Polish and European cases where rulings have been made on the matter of the right to a clean environment and clean air. These considera-tions become the grounds for determining what rulings can be made and whether they can be effectively enforced.

The community continues to be disturbed when strobe lights and sirens are abused. While sirens are used by private vehicles, they cause other drivers to automatically move aside to give way to the oncoming vehicle, strobes or light beams cause other drivers to feel blinded. This study employs a sociological method of empirical legal research. This study aims to examine how law enforcement uses Siyasah Dusturi­yah and Law No. 22 of 2009 to target the usage of strobes and sirens on private vehicles. Law enforcement has taken steps to enforce the law on the use of strobes and sirens, including outreach with vehicle communities, based on the findings of the research. In line with Islamic teachings, the community and students have taken into consideration various aspects, particularly when viewed through the lens of Siyasah Dusturiyah. These include highlighting the advantages of promot­ing legal compliance and awareness as well as enhancing traffic safety and comfort.

Simplified proceedings, such as immediate coercion and direct coercion, are the subject of consideration in this study. The discussion focuses on the essence and aspects of proceedings referred to in Article 117 and 150 § 3 of the Act of 17 June 1966 on enforcement proceedings in administration. The aim of the research is to attempt to evaluate simplified proceedings as a tool in the system of protection of the most important human values.
The research mainly used the legal-dogmatic method of interpreting the content and ordering the legal structure. The analytical method was also applied, by means of which analyses were made of legal provisions concerning the basis for the appli-cation of the simplified procedures in administrative enforcement proceedings.
From the conducted research, it is clear that the primary goal of these proceed-ings is to counteract the indicated threats. The collected research material allowed confirming the thesis and presenting a de lege ferenda motion regarding the necessity to amend Article 117 of the Administrative Enforcement Act. The changes should consist in waiving the necessity to serve a reminder to the debtor before applying this procedure. The provision currently in force omits such a possibility, and the waiver itself may be the result of the need to save important values in an emergency.

The issue of online sexual exploitation of children is a growing concern worldwide, and there is a pressing need to strengthen legal protection measures for children. International laws and conventions have been established to protect children from online sexual exploitation, but the enforcement of these laws faces several challen-ges, such as the difficulty of identifying perpetrators and the lack of resources and expertise in law enforcement agencies. Additionally, cultural and social norms may discourage children from reporting incidents of online sexual exploitation. However, there are prospects for improving legal protection measures, such as through increased international cooperation and coordination, awareness-raising campaigns, and capacity-building for law enforcement agencies. Overall, address-ing the issue of online sexual exploitation of children requires a multifaceted approach involving legal, social, and technological measures.

The amendment of Article 209 of the Polish Criminal Code, which took place on 31 May 2017 with the entry into force of the Act of 23 March 2017 on Amendments to the Criminal Code Act and the Act on Assistance to Persons Entitled to Maintenance (Journal of Laws of 2017, item 952), resulted in significant changes not only in the wording of the said article itself, but also in the picture of the statistical effects of pre-trial and court proceedings for the crime in question. From the very beginning, the said amendment raised questions and reservations among a substantial number of supporters of the established line of judicial decisions issued in the domain of criminal law. They considered it unfit to keep to the principles of adequacy and proportionality, as well as posing a threat to a significant – and ultimately destructive – increase in the burden on law enforcement authorities and the judiciary in general. At the same time, taking into account the main objectives and ideas of the amendment, which was intended in particular to improve the enforcement of maintenance obligations, it needs to be said that it proved ineffective and was actually a manifestation of penal populism.

The rule of law does not govern all human interactions. There are times when the state bypasses legal constraints, as documented by the World Justice Project. Other times, jurisdictions may be mutually unfriendly and refuse to enforce foreign laws. Blockchains create trust between contracting parties at the individual level, enabling them to transact freely and increase consumer welfare. Blockchains can only supple-ment antitrust if the legal constraints do not impede their development. The law should thus support the decentralization of blockchains so that blockchain-based mechanisms may take over (even if imperfectly) where the law does not apply. With that in mind, we justify the attractiveness of that approach by showing that blockchain causes an increase in the number of transactions by creating trust (Part 1), and that it may overall increase the decentralization of economic transactions (Part 2). The law should take into account where it applies (Part 3). We conclude afterward (Part 4).

The ambiguity of understanding and use of the term “human rights” reduces the effectiveness of the law-making and law enforcement activities of state and inter-national bodies, creates negative conditions for the formation of the unified worl-dview and legal position of future lawyers and representatives of other humanities. This article aims to define, formulate the content and describe the legal essence of the term “human rights,” and to substantiate the thesis about the harmfulness of the legal science, law-making and law enforcement use of this term with different meanings. The leading method of research is the method of analysis, which allows one to study the subject, imaginatively dividing it into constituent elements, and to consider each of the selected elements separately within a single whole. This article presents the argumentation of the need for a single wording, understanding, and use of the legal term “human rights.” The materials of the article have practical value for the effective implementation of the law-making and law enforcement activities of state and international bodies, for the formation of the unified worldview and legal position of future lawyers and representatives of other humanities, as well as for a correct and clear explanation of problems with the implemen-tation and protection of human rights.

The article is devoted to the study of the correct application of the evaluative concepts contained in the norms of the Convention for the Protection of Human Rights and Fundamental Freedoms. Attention is drawn to certain difficulties in the application of the evaluative norms in the Convention: despite their objective necessity and usefulness, they create a room for the law enforcement entity’s own discretion up to subjectivism in resolving specific cases; they serve as an objective obstacle to the unification of the case law of the ECtHR and this creates preconditions for unequal implementation of ECtHR judgments in the national legal order; they cause the risk of errors in the application of the provisions of the Convention by the competent authorities of the Contracting States. It is established that the application of legal norms containing evaluative concepts is challenging not only owing to the specific properties of the evaluative concepts themselves, but also due to the peculiarities of adjudication by the ECtHR when applying the evaluative norms. The relevant case law of the ECtHR as well as examples of national legislation are analysed in support of these theoretical conclusions. Since the lack of uniform application of the evaluative norms of the Convention causes divergent use of the ECtHR’s judgments in the domestic judicial system, it is advised to follow a number of rules for reasoning of decisions by the domestic court. These rules will serve as a certain guarantee against ambiguous implementation of ECtHR judgments at the national level.

The paper focuses on the issue of public enforcement of consumer law in Poland. This analysis considers exclusively the stage of administrative proceedings and it does not concern judicial control over the decisions issued. The analysis aims at answering the question whether the phenomenon of legal impossibilism is to be observed in the domain administrative proceedings instituted by the President of the UOKiK with the purpose of implementing consumer policy. The hypotheses to be verified in the foregoing are as follows: (i) there are procedural mechanisms which enable an authority to effectuate protection of consumer rights, operating to the public benefit, and that (ii) it might be reasonable to expect that these mechanisms are exploited in practice by the President of the UOKiK. The first part considers the legal framework for enforcing consumer rights with the use of public law mechanisms in Poland. In the second part, the discussion revolves around the
practical application of the legal instruments by the President of the UOKiK. The
conclusions constitute a starting point to initiate further, in-depth empirical studies
related to the activities undertaken by the President of the UOKiK with the aim
to effectuate protection of consumer rights in Poland.

The article attempts to confront the concepts relating to the force of res judicata and its subjective limits present in the doctrine and jurisdiction with the current wording of the provisions regulating this institution and the provisions concerning enforcement-warrant proceedings which ensure a possibility to pursue a claim indicated in a judgment having the force of res judicata through enforcement proceedings. In the following article, the author presents the existing assumptions of the doctrine regarding mutual relations between the validity of judgment and the authority of res judicata. The author also analyses the possibility of granting the enforcement order against as well as in favour of a third party intervener, but also a uniform participant not indicated in the operative part of the judgment from the standpoint of the doctrine and jurisdiction. Taking into account the above mentioned considerations, the author concludes that in the light of the existing regulations, the concept of the force of res judicata whose subjective scope is limited to the parties to the proceedings indicated in the operative part of the judgement seems to be the most adequate.

The increased effectiveness of competition law enforcement has contributed to th appearance of an atypical type of cartel, which engages not only competitors, but also their common supplier (or retailer). The so called hub-and-spoke cartel consists in the exchange of strategic information between two or more horizontal competitors (spokes) via a common contractual partner active at a different level of the production/distribution chain (the hub), who often also contributes to stabilizing a cartel. Due to the existence of the vertical element of this indirect information exchange, the question arises whether it should be assessed in the same way as its direct equivalent, i.e. as a “by-object” restriction of competition, thus, not requiring an analysis of its actual effects. Although the EU institutions have not adjudicated a hub-and-spoke collusion case yet, the jurisprudence of the national courts may provide useful guidance on what the constituent elements of the hub-and-spoke collusion are and how to assess this practice under the EU competition law. The analysis of both national and EU case law allows to contend that the hub-and-spoke cartels should amount to de facto horizontal information exchange and be assessed in accordance with the “by-object” standard. However, the hub-and-spoke collusion may equally constitute a part of a normal negotiation process (e.g. bargaining) with trading partners, as well as give rise to several efficiency gains, which should be taken into account in examining the practice concerned under the EU competition law.
